Deceased-owner record questions

Plain answers with careful boundaries.

Does BCAD showing the deceased owner mean no one inherited the house?+

No. The appraisal record and recorded title are different evidence layers. Inheritance may arise through a recorded transfer-on-death/life-estate instrument, will/probate, or intestacy even before an appraisal record is updated.

Does paying the taxes make me the owner?+

Not by itself. Payment may protect the property, but it does not alone determine heirs, shares, title or authority. Keep the source, purpose and receipt and avoid representing payment as a deed.

Can one family member sign because everyone agrees?+

Family agreement does not automatically create signing authority or establish title. Identify every interest, the legal route, the authorized actor and the documents required by the institution or transaction.

Is an affidavit of heirship a deed?+

No. TexasLawHelp explains that an affidavit of heirship records family-history/heirship facts and does not itself transfer title. Its legal and title-company treatment is fact-specific; get qualified guidance.

Can we use a small estate affidavit for the house?+

Texas small-estate rules are specific, including limits concerning real property and homestead. Do not choose it from the estate's apparent size alone; use current Bexar policy and legal advice.

What if there was a transfer-on-death deed?+

Retrieve the recorded instrument and confirm validity, beneficiary survival, liens and any required affidavit-of-death/recording steps. Do not prepare a new TODD after the owner's death.

Can we update BCAD before clearing title?+

BCAD publishes evidence requirements for ownership/exemption updates, including deceased-owner situations. Follow its current process, but understand that an appraisal update is not a substitute for resolving title or probate authority.

Who should insure the property?+

Notify the current carrier truthfully about the death, occupancy/vacancy, condition and responsible contacts. Ask what authority/evidence, named insured, safeguards and deadlines apply. Do not assume the old policy continues unchanged.

Can a relative living there be removed?+

Do not use self-help lockout, utility interruption or disposal. Possession, tenancy, homestead and ownership questions can overlap. Document facts and obtain Texas legal guidance.

When can the house be sold?+

After the selling interest, authority, required participants, occupancy, title conditions and transaction disclosures are understood. The deceased name on one record is neither automatic permission nor an automatic prohibition.
